The petitioner is apprehending his arrest in connection with Markaccho PS Case No.51 of 2025, corresponding to GR No.691 of 2025, for offence registered under section 303(2), 317(2) of BNS, 2023, Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004, pending in court of learned Judicial Magistrate First Class, Koderma. 3. Learned counsel for the petitioner submits that petitioner happened to be owner cum driver of the tractor and allegations are made that 80 cft sand was loaded on the said tractor and he further submits that sand was being carried for personal use and petitioner has got no criminal antecedent as disclosed in paragraph no.9. 4. Learned State counsel opposes prayer and submits that illegally the sand was being carried on the said tractor. 5. Considering that petitioner happened to be owner cum driver of the tractor and the sand was being carried for personal use and the petitioner has got no criminal antecedent as aforesaid, and in that view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today, and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
