JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court, seeking the following prayer: "i) Call for the relevant records; ii) Allow this Criminal Petition and quash the FIR in R.C.No.02(A)/2026/CBI/ACB/BLR for the offence punishable under Section 13(2) r/w 13(1)(b) of Prevention of Corruption Act, 1988 (as amended in 2018) and under Section 13(2) r/w 13(1)(e) of P.C. Act, 1988 registered by Respondent-CBI now pending on the file of XXI Addl. City Civil & Sessions Judge & Principal Special Judge for CBI Cases (CCH 4), Bangalore City, in the interest of justice and equity. iii) Pass any such other Order/s as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity." - 3 - HC-KAR NC: 2026:KHC:20809 CRL.P No. 2730 of 2026 2. Heard Sri. C.H. Jadhav, learned Senior counsel appearing for the petitioner, Sri. Prasanna Kumar, learned counsel appearing for the respondent and have perused the material on record. 3. Learned Senior counsel, Sri. C.H. Jadhav appearing for the petitioner submits that during the subsistence of the proceedings the accused is dead. 4. In the light of the sole accused dying during the proceedings, the proceedings stand abated against the said accused as the offence was the one punishable under Sections 13(2) and 13(1)(b) of the Prevention of Corruption Act, 1988. 5. Learned Senior counsel submits that at the time of registration of the crime, several seizures had taken place of the material found at the time of search. 6. In the light of the proceedings standing abated, the natural corollary would be release of those items that were seized at the hands of the respondent - CBI to the family of the petitioner. - 4 - HC-KAR NC: 2026:KHC:20809 CRL.P No. 2730 of 2026 7. On the aforesaid reasons, the petition stands disposed with a direction to the respondent - CBI as a consequence of the proceedings getting abated to release the seized material to the hands of the family of the petitioner.
