2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself. 3. Heard the learned counsel for the petitioner as well as the learned Counsel for the State appearing on behalf of the first respondent. Since no adverse order is going to be passed, notice to the respondents 2 to 4 is dispensed with. 4. The learned counsel appearing for the petitioner submitted that the petitioner had served as the Secretary of the fourth respondent Co-operative Society. Alleging certain irregularities committed by the petitioner, the respondents initiated disciplinary proceedings and conducted an enquiry under Section 81 of “the Tamil Nadu Co-operative Societies Act, 1983” (hereinafter referred to as "the Act"). Based on the findings of the enquiry, surcharge proceedings were initiated, culminating in an order directing the petitioner to pay a sum of Rs.19,20,984/- together with interest. Aggrieved by the surcharge order, the petitioner preferred an appeal before the Co-operative Tribunal, which came to be dismissed. Challenging the same, the petitioner has filed a Special Leave Petition before the Hon'ble Supreme Court, which is presently pending at the diary stage. In the meanwhile, proceedings were initiated under Section 143 of the Act for bringing the petitioner's property to sale for recovery of the surcharge amount. Challenging the said auction proceedings, the present Writ Petition has been filed. 5.The learned counsel for the petitioner further submitted that, if sufficient time is granted, the petitioner is willing to deposit the demand amount. 6. Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioner, this Court directs the petitioner to deposit a sum of Rs.9,20,984/- before the respondent within a period of six weeks from the date of receipt of a copy of this order. In default of such deposit, it is open to the respondents to proceed with the recovery proceedings in accordance with law.
