Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 253 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 05.05.2026, for the offences punishable under Section 103(1), 137(2), 191(2), 191(3), 238, 296(b), 351(3) and 304 of BNS, in Crime No.253 1/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.13331 of 2026 of 2026 on the file of the respondent police, seeks bail. 2. The allegation against the petitioner is that the petitioner herein is the friend of A1 & A2, who are named accused in the FIR, and it is alleged that A1's wife was abused by the deceased in this case. Hence, A1 & A2, along with others, came to house of deceased and abducted him into a lonely place and tied his hands and brutally attacked him, which resulted in causing severe injuries, and subsequently, he succumbed to injuries. Hence, the present complaint has been registered. 3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner herein ranked as A3 however, his name has not been found place in the FIR and the petitioner has no bad antecedents. Hence, he prayed for grant of bail to the petitioner. 4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that there are totally 5 accused in this case and all the accused were arrested and in custody and the investigation is still pending. He further submitted that the petitioner 2/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.13331 of 2026 has no bad antecedents. However, he opposed to grant bail to the petitioner. 5. I have gone through the FIR and also the connected materials. 6. Considering the nature of allegations against the petitioner, and considering the period of incarceration undergone by the petitioner and he has no bad antecedents, this Court is inclined to grant bail to the petitioner subject to certain conditions. [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Aranthangi, and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation: [c] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioner shall not abscond either during investigation 3/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.13331 of 2026 or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
