The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.34/2026, registered at Police Station – Lormi, Mungeli (C.G.) for the alleged commission of offence punishable under Sections 74m, 296, 351(2) of BNS, 2023 and Section 8 of POCSO Act. 2. on 28/01/2026, the father of the prosecutrix has lodged a report at police Station Lormi against the applicant with the allegation that, on 15/01/2026, her younger daughter and prosecutrix went to the Anand Mela, Lormi, and a around 8:00 pm, the present applicant holds the hand of the prosecutrix with the malicious intent, molested VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.23 17:10:21 +0530 2 her and hurled abuses at her and threatened to kill her. On 21/01/2026, at around 12:00 pm the applicant came in front of the house of the prosecutrix, and wrote "Happy Birthday S", burst firecracker an went away. On the morning of the following day of 22/01/2026, his daughter informed him and her family regarding the actions of the applicant and the incident that took place on 15/01/2026. On the said report of the complainant offence under section 74, 296, 351(2) of the BNS & 8 of the POCSO Act was registered against the applicant. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that applicant and victim has love relationship and there is no evidence in the case against the applicant and applicant is not required to be harassed by the police. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant and submits that victim is a minor girl aged about 17 years and notice has been served to the father of the victim on 13.03.2026. She further submits that as per the statement recorded under Section 183 of BNSS, in which she stated that there was some affair between the applicant and victim and since 2021 she was in contact with the applicant, but after in the year 2025 she has stopped talking to him, thereafter applicant used to forced and harassed her again and again therefore, applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the nature and gravity of the offence and material available on record in the case diary, submissions made by learned counsel for the parties and also looking to the statement of the victim under Section 183 of BNSS and conduct of the applicant and allegation levelled against him which is of serious nature i.e. molesting a minor girl, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Hariom Rajput filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.34/2026, registered at Police Station – Lormi, Mungeli (C.G.) for the alleged commission of offence punishable under Sections 74m, 296, 351(2) of BNS, 2023 and Section 8 of POCSO Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
