This Habeas Corpus Petition has been filed for a direction to the respondents to secure and produce the person or body of the detenue, who is the daughter of the petitioner, and to set her at liberty. 2. When the matter was taken up for hearing today, the detenue was present before this Court and stated that her date of birth is 22.06.2009 and that she developed a love affair with the 3rd respondent. Since there was compulsion from her parents to get her married, she went along with the 3rd respondent. We requested the petitioner, who was present before this Court, https://www.mhc.tn.gov.in/judis to take her daughter along with her. She insisted that her daughter can stay in the Home and that she is more interested in prosecuting the criminal case. 3. In the light of the above statement made by the petitioner, there shall be a direction to the first respondent to transfer the case to the Inspector of Police, All Women Police Station, Peraiyur. The concerned Inspector of Police shall alter the offence and ensure that the medical examination of the victim girl is conducted and her statement is also recorded under Section 183(5) of BNSS. For the present, the detenue shall be taken care of by the Child Welfare Home, Muthupatti, Sivagangai District. 4. With the above directions, this Habeas Corpus Petition is disposed of. (N.A.V.,J..)
