For the State : Mr. Shiv Shankar Kumar, A.P.P. ----- 03/ 25.02.2026 This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been filed to release the petitioner on regular bail in connection with Kenduadih P.S. Case No.56 of 2025, for offences under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 117(2), 118(1), 109(1) and 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023. The case is presently pending before the Court of learned J.M. 1st Class, Dhanbad. 2. Heard learned counsel representing the petitioner and learned A.P.P. representing the State. Perused the material available on record and also gone through the impugned order. 3. Opportunity was given to the State to oppose the bail, which the State availed and opposed. 4. The allegation against the petitioner is that he along with other anti-social elements, with sword, axe and knife in their hands, assaulted the informant and her family members and also 2026:JHHC:5786 2 threatened to kill them. Due to the said assault the informant and her family members sustained grievous injuries. 5. From the case diary, injury report and statements of the witnesses namely Mahesh Yadav (at para-70), and Sunil Kumar Yadav (at para-71), I find that there is a direct allegation against the petitioner. Both these witnesses stated that Chhotu @ Teni Yadav (petitioner herein), with a sword in his hand, had assaulted Akshay Kumar. The said assault resulted in six injuries, in which there are lacerated wounds on the left temporal region, occipital region and left hand; there are abrasions over left cheek, right upper limb and back. 6. Considering the statements of the above named two witnesses coupled with the injury report, I am not inclined to release this petitioner on bail, at this stage. 7.
