Petitioner has filed the present petition under Articles 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, with the following prayers: "(a) CALL for the records which ultimately resulted in registering ANNEXURE-A, B, C & H CC No. 62714/2023 - 3 - HC-KAR CNR: KAHC010677252024 NC: 2026:KHC:54506 WP No. 36047 of 2024 (FIR No. 130/2023) on the file of the XI ACMM, Bangalore. (b) ISSUE an order, direction or Writ in the nature of Certiorari, quashing the order dated 29-12-2023 vide Annexure-H passed by the XI ACMM, Bangalore in taking Cognizance of the Offences against the Petitioner, quashing of the Charge Sheet dated 13/12/2023 filed by the Respondent No. 1 vide Annexure-C and quashing of the FIR in Crime No. 130/2023 dated 15-06-2023 vide Annexure - A against the Petitioner in C.C No. 62714/2023 arising from Crime No. 130/2023 for the offences punishable under sections 427 and 447 of the IPC filed by the Kothanur Police Station (c) ISSUE such other reliefs which this Hon'ble Court may deem fit in the facts and circumstances of the case." 3. At the outset, counsel for the petitioner would submit that the civil dispute is duly compromised before the Civil Court in O.S.No.1003/2023. Copy of the compromise petition is placed on record vide Annexure-F. 4. Hence, the following: O R D E R [I] Petition is allowed. [II] Consequently, order dated 29-12-2023 passed by the XI ACMM, Bangalore in taking Cognizance of the Offences, Charge Sheet dated 13-12-2023 filed by the Respondent No.1 and the FIR in Crime No.130/2023 dated 15.06.2023 in C.C.No.62714/2023 arising from Crime No.130/2023 for the offences punishable under Sections 427 and 447 of the Indian Penal Code filed by the Kothanur Police Station, pending before the XI Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru City, qua the petitioner is hereby quashed.
