Learned counsel for the petitioner would submit that the convict prisoner was earlier granted parole for performing his marriage and after marriage, his wife/petitioner is now pregnant and therefore, she made an application to the respondents seeing emergency leave to her husband to take care of her. The respondents have rejected the same vide impugned order and challenging the same, this writ petition has been filed. 2. Learned Counsel for State of Tamilnadu(Crl.Side) would submit that the convict prisoner has got pending cases. However, emergency leave cannot be granted on the ground of visiting the pregnant wife and further, the convict prisoner has not completed three years, as such he is not eligible for availing ordinary leave. Hence, the authorities have rightly passed the impugned order which does not require interference by this Court. 3. We find merits in the contention of the learned Counsel for State of Tamilnadu(Crl.Side). Accordingly, this petition is dismissed. No costs. (A.D.JAGADISH CHANDIRA J.)
