CMP(M) No. 294 of 2025 The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that the impugned judgment dated 07.10.2025 was passed by the learned District Judge, Mandi, H.P., whereby the appeal filed by the appellant was dismissed. It has further been averred that at the relevant time, the applicant was not in good health and was suffering from multiple diseases, due to which he could not contact his counsel. After recovering from the said ailments, he contacted his counsel and requested him to obtain a copy of the judgment and decree. On receiving the same, he came to Shimla in the second week of December, 2025. Thereafter, the learned counsel directed the applicant to collect the entire case file. In this process, a delay of 61 days occurred in filing the appeal. The applicant has further submitted that the delay in filing the present appeal is neither intentional nor deliberate, but has occurred on account of bona fide reasons, as stated in the application. In view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions as made by learned counsel for the parties, the present application is allowed and the delay in filing the appeal is condoned. The application stands disposed of. RSA No.____/2026 (RSAST No. 8819/26) Appeal be registered. It is contended by learned counsel for the parties that there is a dispute between real brothers. Therefore, an endeavour can be made to reconcile the matter between the parties. Consequently, the parties are directed to remain present in the Court on 19.05.2026.
