2. The learned counsel for the petitioner would submit that the 5th respondent is the owner of the vehicle was set ex parte before the Tribunal and he would seek notice to 5th respondent may be dispensed with. Hence, notice to R5 is dispensed with.
3. Being satisfied with the reasons stated in the supporting affidavit, delay is condoned and this petition is allowed. Registry is directed to number the appeal, if the papers are otherwise in order.
