1. Mr. B.M. Pingal, learned counsel for the petitioner.
2. Mr. D.K. Bankoti, learned Brief Holder for the State of Uttarakhand.
3. Petitioner was appointed on consolidated salary as Sweeper in the Department of Sainik Kalyan & Punarvas reportedly w.e.f. 22.10.1986 and his services were regularised on the post of Sweeper w.e.f. 18.06.2012.
4. By means of this writ petition, petitioner has sought a direction to respondent nos. 2 & 3 to consider his claim for pension under the Old Pension Scheme by counting the services which he rendered since 22.10.1986.
5. Learned State Counsel submits that petitioner has sought writ of mandamus without making any formal representation to the Competent Authority.

Learned counsel for the petitioner, however, submits that petitioner has made a representation to Director concerned on 08.10.2021. He submits that petitioner be permitted to make fresh representation to the Competent Authority.
7. The writ petition is, accordingly,
disposed of by permitting the petitioner to make fresh representation to the
2026:UHC:3351 Competent Authority within two weeks. If he makes representation within the stipulated time, decision thereupon shall be taken within three months thereafter.
