JUSTICE M.I.ARUN ORAL ORDER This writ petition is filed against the order dated 27.11.2025 [Annexure-A to the writ petition] which is passed on the allegation that the petitioners are operating commercial/industrial undertakings in the premises which are meant to be used for residential purposes. The order is passed by respondent No.3. Aggrieved by the same, the petitioners have submitted a representation dated 30.12.2025 [Annexure-K to the writ petition] to respondent No.3 and they have challenged the issuance of the order [Annexure-A to the writ petition] in the instant petition. 2. The case of the petitioners is that they were not in the receipt of the earlier notices issued prior to passing of the impugned order dated 27.11.2025 [Annexure-A to the writ petition]. It is further submitted that the representation [Annexure-K to the writ petition] - 6 - HC-KAR NC: 2026:KHC:15620 WP No. 3402 of 2026 justifies why they should be permitted to continue their businesses. 3. Learned counsel for GBA, upon instructions, submits that notices were issued to the petitioners prior to passing of the impugned order at Annexure-A to the writ petition. However, upon instructions, he submits that a decision has been taken to consider the impugned order [Annexure-A to the writ petition] as a show cause notice and the representation of the petitioners [Annexure-K to the writ petition] will be taken into consideration and appropriate orders will be passed thereafter. He prays that a direction to that effect be ordered by this Court. The petitioners are agreeable for the same. Hence, the following: ORDER [a] Writ petition stands disposed of. [b] Respondent No.3 is directed to consider the impugned order dated 27.11.2025 [Annexure-A to the writ petition] issued by him, as a show - 7 - HC-KAR NC: 2026:KHC:15620 WP No. 3402 of 2026 cause notice and the representation of the petitioners dated 30.12.2025 as a reply to the allegations made in the impugned order at Annexure-A to the writ petition, and consider the same in accordance with law and pass appropriate orders thereafter.
