JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.7 in Crime No.86/2020 registered by Basavanagudi Police Station, Bengaluru City, for the offences punishable under Sections 120B, 149, 406, 420, 465 and 409 of Indian Penal Code, 1860, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. - 3 - HC-KAR CNR: KAHC010646562026 NC: 2026:KHC:54340 CRL.P No. 14372 of 2026 3. FIR in Crime No.86/2020 was registered by Basavanagudi Police Station, Bengaluru City for the aforesaid offences against Imtiyaz Sait and others, based on the first information dated 10.10.2020 received from Sri. Jayadeep N.T., S/o. Rajagopal P., who is the alleged victim in the present case. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.7992/2026 before the jurisdictional Sessions Court, which was rejected on 02.09.2026. Therefore, he is before this Court. 4. The petitioner, who is arrayed as accused No.7 in the FIR, appears to have co-operated with the police for the purpose of investigation and his statement was also recorded by the Investigating Officer on 29.10.2020 during the course of investigation. A copy of the said statement has been made available to this Court by the learned counsel for the petitioner. 5. After completing investigation, charge sheet is already filed in the present case. All the other accused - 4 - HC-KAR CNR: KAHC010646562026 NC: 2026:KHC:54340 CRL.P No. 14372 of 2026 persons have been granted bail in the present case. The jurisdictional Sessions Court has rejected the bail application of the petitioner mainly on the ground that he has been absconding ever since the date of registration of the FIR in the present case. The said observation made by the learned Sessions Judge appears to be incorrect, since it is found that the petitioner has co-operated with the police for the purpose of investigation and his statement was also recorded by the Investigating Officer. The petitioner is a senior citizen aged 65 years. 6. Considering the aforesaid aspects of the matter and since all the other accused persons have been enlarged on bail in the present case, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: - 5 - HC-KAR CNR: KAHC010646562026 NC: 2026:KHC:54340 CRL.P No. 14372 of 2026 O R D E R i) The criminal petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.86/2020 registered by Basavanagudi Police Station, Bengaluru City for the offences punishable under Sections 120B, 149, 406, 420, 465 and 409 of IPC, 1860, subject to the following conditions: a) The petitioner shall appear before the Jurisdictional Court within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the Jurisdictional Court. b) The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 6 - HC-KAR CNR: KAHC010646562026 NC: 2026:KHC:54340 CRL.P No. 14372 of 2026 c) The petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. d) The petitioner shall not involve in similar offences in future.
