Palanivel, Government Advocate (Criminal side) ORDER The petitioner, who apprehends arrest for the alleged offences under Sections 85 and 318(4) of B.N.S. and Section 4 of the Dowry Prohibition Act in Crime No.43 of 2025, on the file of the respondent police, seeks anticipatory bail. https://www.mhc.tn.gov.in/judis CRL OP No. 15894 of 2026 __________ Page2 of 6 2. The case of the prosecution is that the marriage between the defacto complainant and the 1st accused was solemnized on 24.11.2023. As there were matrimonial disputes between them, the defacto complainant left the matrimonial home in the month of May 2024. The 1st accused along with other accused, has committed ‘cruelty’, ‘cheating’ and ‘dowry harassment’ against the defacto complainant. Hence the case. 3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has nothing to do with the commission of offences as alleged by the prosecution. He would further submit that according to the prosecution, the issues are in respect of cruelty, cheating and dowry harassment, that the petitioner is the brother-in-law of the 1st accused and the FIR came to be registered on 02.07.2025 for the occurrence alleged to have taken place during the period between 2023 and 2024. At this juncture, he would further submit that except this petitioner, all other accused were granted anticipatory bail vide order passed in Crl. O.P. No.24513 of 2025 dated 05.11.2025. Hence, he prays to grant anticipatory bail to the petitioner. 4. At this juncture, the learned Government Advocate (Crl.Side) appearing for the respondent police strongly objected the anticipatory bail petition by reiterating the prosecution case. https://www.mhc.tn.gov.in/judis CRL OP No. 15894 of 2026 __________ Page3 of 6 5. Heard the submissions made by the learned counsel on either side and perused the materials available on record. 6. From the submissions made on either side, it is pertinent to mention that the wife of this petitioner is the sister of the 1st accused qua husband of the defacto complainant, was granted anticipatory bail and this petitioner is only the brother in law of A1. In such view of the circumstances, this Court is of the firm view that, at this length of time, the custodial interrogation of the petitioner is not required and hence, this Court is inclined to enlarge the petitioner on anticipatory bail, subject to certain conditions: 7. Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate No.1, Arakkonam, Ranipet District on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioner fails to surrender before the concerned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; https://www.mhc.tn.gov.in/judis CRL OP No. 15894 of 2026 __________ Page4 of 6 (b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity; (c) The petitioners shall appear before the respondent police daily at 10.30 a.m. and 5.30 p.m. until further orders; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560]; (e) If the petitioner thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act. 25-06-2026 MJS Note: 1.
