According to the petitioner, despite commencement of contract, the respondent failed to perform the operation services in accordance with the contract. Subsequently, disputes arose between the parties in relation to the said contract. 3. The respondent sent a legal notice dated 23.10.2025 (Annexure-E) to the respondent and petitioner has replied to the said notice on 23.01.2026 (Annexure-F) referring to the arbitration clauses contained in the Tender Notification and Agreement. The respondent did not furnish any reply to the said notice dated 20.06.2026. Hence, the present petition is filed seeking appointment of a sole Arbitrator. 6. The learned counsel appearing for the respondent submits that respondent has no objection to the appointment of sole Arbitrator. However, he seeks that all the contentions of the parties be kept open to be urged before the learned Arbitrator. 7. Having regard to the existence of the arbitration clause contained in the Agreement, which provides for resolution of disputes arising between the parties, and the fact that the petitioner has duly invoked the said arbitration clause by issuing notice under Section 21 of the Act, this Court is of the opinion that a Sole Arbitrator is required to be appointed for adjudication of the disputes between the parties. 8.
