[2026:RJ-JP:12203] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11460/2025 Sheetal Singh @ Rajendra Singh S/o Kamal Singh Chouhan, aged about 29 Years, R/o Bhanwarasa, Police Station Jeeran, District Neemach (M.P.) ----Applicant Versus State of Rajasthan through PP ----Respondent For Petitioner(s) : Mr. Ritesh Jain For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 24/03/2026 1. The present anticipatory bail application has been filed under Section 482 of the BNSS, 2023 in connection with FIR No. 284/2023 registered at Police Station Bhinay, District Kekri for the offence(s) under Sections 8/15 of the NDPS Act, 1985. 2. Learned counsel for the applicant has submitted that the applicant is the sole bread earner of his family. It is further submitted that the applicant has been falsely implicated in the instant matter solely on the basis of the hearsay and confessional statement of the co-accused. It is next submitted that although the recovered contraband i.e., 110 kg of dodapost is higher than the prescribed commercial quantity of 50 kg, learned counsel has placed reliance upon the ratio spelled out by the Co-ordinate Bench of this Court in Bhayyu @ Shoaib Khan v. The State of [2026:RJ-JP:12203] (2 of 2) [CRLMB-11460/2025] Rajasthan, S.B. Criminal Bail Application No. 3861/2026, decided on 19.03.2026 to seek the concession of anticipatory bail. 3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application by placing reliance upon the statutory embargo enshrined under Section 37 of the NDPS Act. It is submitted that the total quantity of contraband recovered i.e., 110 kg of dodapost, is more than the prescribed commercial quantity of 50 kg. It is further submitted that the applicant has been absconding for a long period of time and is deliberately avoiding the process of law. 4. Having heard the arguments advanced by learned counsel for the parties and taking note of the fact that the recovered contraband is more than the prescribed commercial quantity, thereby the rigours of Section 37 of the NDPS Act would be applicable in the instant matter; that the applicant has been absconding and deliberately avoiding the investigation, and considering the overall facts and circumstances of the case but without commenting on the merits/demerits of the case, this Court is not inclined to allow the anticipatory bail application of the applicant. 5. Accordingly, the instant anticipatory bail application filed under Section 482 of the BNSS, 2023 stands dismissed. (SAMEER JAIN),J JKP/2
