JUDGMENT : PADAM NARAIN MISHRA, J. 1. Heard learned counsel for the applicant and learned A.G.A. for the State. 2. The present application u/s 528 BNSS has been filed with a prayer to quash the impugned order dated 5.3.2025 passed by Principal Judge, Family Court, Gyanpur, Bhadohi, in Criminal Misc. Case No. F25 of 2025, under Section 147 of BNSS, Police Station Gopi Ganj, District Bhadohi, pending in the Court of Principal Judge, Family Court, Gyanpur at Bhadohi. 3. After some argument, learned counsel for the applicant submitted that he is ready to pay the dues amount to the opposite party no.2 in installment. 4. Learned AGA has no objection to the aforesaid prayer advanced by the learned counsel for the applicant. 5. Keeping in view the poor condition and his financial position, applicant is directed to pay the arrears of maintenance in 4 (four) equal installment in the interval of two months along regular maintenance. Trial court is directed to proceed accordingly. 6. In view of the aforesaid, the impugned order dated 5.3.2026 shall kept in abeyance subject to the satisfaction of the aforesaid condition. 7. It is made clear that if the applicant does not pay the amount as committed before the court, interim protection granted to the applicant shall stands vacated automatically.
