This bail application has been filed under Sections 483 and 484 of the Bharatiya Nagrik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offence punishable under Sections 109, 115(2), 117(2), 126(2), 3(5) of BNS, 2023. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned AddI. P.P. opposes the prayer for bail. 4. It is the case of road rage. While the informant was returning to his home from Dussehra Mela, the petitioner with other surrounded him and assaulted on the head of the informant with sharp cutting weapon. The informant has sustained head injury and he fell on the ground and became unconscious. 5. Considering the direct allegation against the petitioner, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Nawajaipur P.S Case No.47/2025, pending in the Court of learned Judicial Magistrate, Palamau at Daltonganj, stands rejected. 6. Accordingly, this bail application is dismissed. 7. The petitioner is at liberty to renew his prayer of bail after examination of informant victim.
