… for the DPSC, South 24-Partanas. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to consider the representation of the petitioner for her transfer to a school nearby her place of residence. 3. The petitioner contends that she is an Assistant Teacher at Chowbangi Sahid Smriti F P under Jaynagar Circle under District Primary School Council, South 24-Parganas. The petitioner joined in the said school on 13th February, 2017. The petitioner has to travel about 214 kms. to attend her present school. The father of the petitioner is a senior citizen. The petitioner is suffering from serious gynaecological
2 problems. The petitioner made an application on 4th July, 2024 before the Secretary/President, West Bengal Board of Primary Education. However, the same is pending with the authority. Hence, this writ petition. 4. Mr. Sayan Banerjee, learned Advocate for the petitioner seeks liberty to file a comprehensive representation before the Secretary/President, West Bengal Board of Primary Education since the concerned Circle within which the school is situated has not been mentioned in the representation dated 4th July, 2024. 5. Mr. Gourav Das, learned Advocate for the District Primary School Council, South 24-Parganas leaves the matter to the discretion of the Court. 6. In view of such submissions advanced, liberty is granted to the petitioner to make a fresh representation before the Secretary/President, West Bengal Board of Primary Education with necessary particulars within a period of three weeks from date. Upon receipt of such representation the Secretary/President, West Bengal Board of Primary Education shall consider and dispose of the same in accordance with law upon notice to the petitioner by passing a reasoned order within a period of six weeks from the date of receipt of such application. The reasoned order shall be communicated to the petitioner within a week from the date of passing of such order. 3

Learned advocate for the petitioner is directed to communicate this order to the Secretary/President, West Bengal Board of Primary Education, for necessary compliance. 8. With the above direction, the writ petition being WPA 22833 of 2024 stands disposed of. 9. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 10. Interim order, if any, stands vacated. 11. All connected applications, if any, stand disposed of. 12. There shall be no order as to costs. 13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
