IN THE HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI CONSTITUTIONAL WRIT JURISDICTION 29.09.2026 rc/ct.no.CB-06 Item No.174 WPA No. 1815 of 2026 Rajib Kumar Sarkar Versus The State of West Bengal & Ors.
Adv. Bipasha Mrug
..for the petitioner
Adv. Arijit Ghosh Adv. Bibek Tarafder
….for the State
Adv. Mousumi Bhowal Adv. Nigam Mittal …for the DPSC, Cooch Behar
Affidavit of service filed by the petitioner and report submitted by the District Primary School Council, Cooch Behar are taken on record. The fact of the case is recorded in the order dated September 02, 2026. It appears that after rejection of the earlier application for transfer submitted by the petitioner through the online UTSASHREE portal, he submitted further application on July 27, 2026 through the same portal. The application was not processed due to technical glitches in the portal. The report submitted by the District Primary School Council demonstrates that the portal resumed functioning with effect from 01.07.2026 but due to technical errors, the online applications therein cannot be processed.
2 The petitioner cannot suffer for technical glitches in the portal. He has submitted a further application offine before the concerned authority on July 30, 2026 and seeks consideration of the same. In view of the fact that the petitioner seeks transfer on various grounds stated in the application, this Court is inclined to hold that without going into the merits of the application, the application be
directed to be considered by the concerned authority at the earliest. The Chairman, District Primary School Council, Cooch Behar, being the 6th respondent herein, is
directed to consider and dispose of the application submitted offline by the petitioner on July 30, 2026 within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
