(NDPS) 480 of 2026 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NDPS case no. 59 of 2026 arising out of Sahebganj Police Station case no. 534 of 2025 dated 11.9.2025 under Sections 20(b)(ii)(c)/29 of the NDPS Act 1985. And In the matter of : Majidul Ali …. Petitioner Mr. Hillol Saha Poddar …for the Petitioner Mr. Avrojyoti Das, Ld. APP Mr. Rishab Kumar Mr. Atul Dong ...for the State Learned counsel for the petitioner in support of his bail prayer submits that he is in custody for about one year and the charge-sheet has already been submitted against the present petitioner and therefore, further detention of the petitioner will not yield any fruitful result. Accordingly, he may be released on bail on any terms and conditions. Learned counsel for the State opposed the bail prayer contending that the petitioner has criminal antecedents. He further submits that 108 kg. of Ganja was recovered from the exclusive possession of the petitioner. He further submits that rest accused persons are absconding and if he is released on 2 bail, there is serious chance of absconsion and he may commit similar types of offence in future. Having heard learned counsel for the petitioner and the State and that the rigour of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner, the prayer for bail is considered and rejected. However, the Trial court is directed to make his best effort to conduct the charge hearing in respect of the present petitioner at the earliest. Accordingly, CRM (NDPS) 480 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
