DATE : 25.08.2026 Heard the learned counsel for the applicant and the learned APP for the State.
2. This is an application for condonation of delay of 113 days in filing the present criminal appeal. The present criminal appeal is directed against the judgment and order passed by the learned Additional Sessions Judge, Chandrapur, dated 20th February, 2026, thereby convicting the present applicant for the offence punishable under Section 302 of the Indian Penal Code, 1860, and sentencing him to suffer rigorous imprisonment for life.

Learned counsel for the applicant submits that the applicant was arrested in the year 2020 and has been behind bars throughout the trial. In view of the aforesaid fact, the movement of the applicant is restricted. He further invites our 2026:BHC-NAG:11109-DB
103.APPA.637.2026 2/3 attention to the reasons stated in paragraph 2, wherein it is submitted that the applicant is the only earning member of the family, consisting of his old-aged mother, and there is nobody else to pursue his criminal appeal.
4. Learned APP strongly opposes the prayer for condonation of delay, contending that the delay is of more than 100 days and has not been properly explained.
5. In our considered opinion, having regard to the fact that the applicant has been in jail since 2020, that he is in a weak financial condition and that there was nobody to pursue his appeal except his old-aged mother, the applicant has made out sufficient cause for condonation of the delay of 113 days in filing the present criminal appeal.
6. In view of the above, the Criminal Application is allowed. The delay of 113 days in filing the Criminal Appeal is condoned. The Criminal Appeal be registered.
7. The Criminal Application is accordingly disposed of.
