WP No. 24950 of 2026 __________ Page2 of 6 For Petitioner: M/s.N.Jayabharathi For Respondents: Mr.K.Sathish Government Advocate for R1 Mr.S.Arun Kumar Standing Counsel for R2 ORDER The writ petition has been filed seeking a mandamus to the 1st respondent to instruct the 2nd respondent to comply with the direction of the 1st respondent dated 26.05.2026, either to remove the audit objection for the purpose of regularization for the promotion to the post of Deputy Manager (Engg.) and to take further action as per the said direction and pass orders. 2. The petitioner had joined the services of 2nd respondent as Technician on
1987. He had completed part-time Diploma in Mechanical Engineering in the year 2002, with prior permission from the 2nd respondent and was eligible for promotion. The petitioner and two other persons have been promoted to the post of Deputy Manager (Engg.), on 11.01.2019 pursuant to the amendment of the Promotion Rule. However, it appears that no approval was obtained from the General Body for filling up the post of Deputy Manager (Engg.). Be that as it may, the petitioner was issued with audit objection letter dated 21.01.2021, intimating that the petitioner has been paid a sum of Rs.1,89,648/- as excess salary from April 2019 to March 2020, and was required to repay the same within 7 days. https://www.mhc.tn.gov.in/judis

The petitioner would submit that he had submitted a letter dated 27.11.2021 and 23.12.2021 to the 2nd respondent stating that the audit objection was due to non-approval from the General Body and had also requested to depromote him to the post of Technician. Thereafter, the petitioner had submitted several representations in this regard. However, there is no response to his representations, instead, the 2nd respondent without de-promoting the petitioner, had continued to allot work as Deputy Manager (Engg.) in various branches and had also issued notices to pay the difference amount, and that apart, no steps have been taken to obtain approval for the amended Rule. 4. Despite his earlier representations for the aforesaid relief, the petitioner was assigned with additional incharge works in the post of Deputy Manager (Engg.), and hence, he submitted a representation on 03.05.2025 to the 2nd respondent, which was forwarded to the 1st respondent. It is seen that the 1st respondent had addressed a letter dated 26.05.2025, directing the 2nd respondent to act on the representation of the petitioner and to report to him, with a copy marked to the petitioner. The petitioner would contend that he is due to retire in another 10 days and since no steps have been taken by the 2nd respondent to redress his grievances, he apprehends that his terminal benefits would be https://www.mhc.tn.gov.in/judis

Left with no other alternative, the petitioner is before this Court seeking a mandamus to the 1st respondent to instruct the 2nd respondent to comply with the directions issued by the 1st respondent in his letter dated 26.05.2025 and to take necessary action. 5. Heard the learned counsel on either side and also perused the materials placed on record. 6.
Taking note of the fact that necessary instructions were issued to the 2nd respondent by the 1st respondent vide correspondence in Na.Ka.No.9412/N.A.2/2025 dated 26.05.2025, to act on the representation of the petitioner dated 03.05.2025, and that the same has not been complied with to date, by the 2nd respondent, a mandamus is issued to the first respondent to instruct the 2nd respondent once again, to act on the representation of the petitioner, and necessary orders be passed on the petitioner's representation on or before 12.08.2026, and to report compliance before this Court on 13.08.2026. While considering the representation of the petitioner, the second respondent shall take note of the fact that despite the request of the petitioner to revert him to his original post, on account of the audit objection issued to him, and that necessary recommendations have been made by the 1st respondent, and the same has not been given effect to, and time and again, the notices served on the https://www.mhc.tn.gov.in/judis
