Somdutta Patra ….for the State The petitioner’s father Bishnulal Sharma, since deceased, was an assistant teacher of Bagrakote Higher Secondary School, Kalimpong who superannuated March 31, 2007 and expired on March 18, 2023. The petitioner’s mother pre-deceased her father. The other heirs of the deceased reside separately. The petitioner being the unmarried daughter of the deceased and dependant on him financially, applied for family pension before the concerned authority pursuant to which the headmaster, Bagrakote Higher Secondary School, by a letter issued on September 21, 2023, sought sanction for family pension by the District Inspector of School (SE). The District Inspector, by a letter issued on October 24, 2024, sought submission of certain documents by the headmaster which were submitted before the District Inspector of School by a letter 2 issued on February 15, 2025. Sanction for family pension is still awaited. In view of the fact that the application seeking family pension submitted by the petitioner is pending for considerable period of time, the District Inspector of Schools, being the 4th respondent herein is directed to consider and dispose of the same within four weeks from the date of communication of this order. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the said authority arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
