...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate Writ or Order or direction more particularly one in the nature of Writ of Mandamus declaring the action, things and deeds of Respondents in not paying the contract bills amount to the Petitioner i.e., Rs. 55,49,163/- (Rupees Fifty Five lakhs Forty Nine Thousand One Flundred and Sixty Three Rupees Only) in respect of the works executed by the Petitioner within 5th Respondent Municipality, which is illegal, irregular, arbitrary, unconstitutional, against to the Principles of Natural Justice and in violation of Articles 14 and 21 of the Constitution of India, consequently to direct the Respondents to pay the total contract bills amount of Rs.
55,49,163/- (Rupees Fifty Five lakhs Forty Nine Thousand One Hundred and Sixty Three Rupees Only) along with interest for the works carried by the Petitioner and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents forthwith to pay the total contract bills amount of Rs. 55,49,163/- (Rupees Fifty Five lakhs Forty Nine Thousand One Hundred and Sixty Three Rupees Only) along with interest in respect of works carried by the Petitioner pending disposal of the Writ Petition and pass Counsel for the Petitioner:

ORDER:
1. The petitioner is aggrieved by the action of the respondents in not paying the contract bills amount to the Petitioner i.e., Rs. 55,49,163/- (Rupees Fifty Five lakhs Forty Nine Thousand One Hundred and Sixty Three Rupees Only) in respect of the works executed by the Petitioner within 5th Respondent Municipality i.e., Transportation of drinking water to various places in nandigama Nagar Panchayat from April 2023 to August 2023, Transportation of drinking water to various places in Nandigama Municipality, Digging of kattacha drain for disposal of drainage water from Mandala Babu D.No.2-73 to Chavala Raju D.No.1-236/2 in 7th Ward, Providing katcha drains at various places in DVR colony in 19th ward, Providing CC Raod from Ele Pole No.18w/136 to Uppu Srinu house in 18th Ward, Removal of wet silt and sludge in NSP canal in 12th and 13th wards in Nandigama Nagar Panchayat, Repairs and maintenance of 20 HP motor in old Munneru water supply scheme in 1st ward in Nandigama Nagar Panchayat, Maintenance and repair of water supply pipelines of various sizes, valves, valve pits etc in 11 to 20 wards in Nandigama Nagar Panchayat, Providing painting, door and window curtains, fans and lights in Municipal Chairperson room in Nandigama Nagar Panchayat.
2. The learned counsel further submits that the petitioner duly executed all the works and thereafter submitted final bills, which were duly endorsed by the competent authority. A statement detailing the works executed by the petitioner was prepared, and the progress of the work was recorded in the
4 HN, J W.P.No.5284_2026 M-book. However, in spite of the completion of all procedural formalities, the payment towards the completed works has not been released till date.
3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration & Urban Development, Ms. V.Sirisha Rani, learned Standing Counsel for the Municipality and the learned Assistant Government Pleader for Finance and Planning.
4. During the course of hearing, on written instructions, the learned Standing Counsel appearing for the respondents does not dispute the submissions made by the petitioner with respect to the completion of the work undertaken and that the non-payment of bills is due to paucity of funds.
5. Considering the submissions, the concerned respondents are hereby
directed to verify and release the payments due payable to the petitioner as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order.
6. Accordingly, the writ petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
