JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.2 and 3 in Crime No.123 of 2026 registered by Halasurgate Police Station, Bengaluru City for the offences punishable under Section 316(2), 318(4), 319(2), 351(2), 61(2), 74, 75, 79 of BNS 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.123 of 2026 was registered by Halasurgate Police Station, Bengaluru City for the - 3 - HC-KAR CNR: KAHC010599432026 NC: 2026:KHC:54382 CRL.P No. 13474 of 2026 aforesaid offences against one Yerriswamy and petitioners herein, after the private complaint filed by Smt.Geetha K. Suvarna, was referred to the jurisdiction Police Station by the Court of learned Magistrate before whom the private complaint in PCR No.609 of 2026 was filed by Smt.Geetha K. Suvarna. Apprehending arrest in the case, the petitioners had filed Crl.Misc.No.7769 of 2026 before the jurisdictional Sessions Court, which was rejected on 13.08.2026. Therefore, they are before this Court. 4. A reading of the private complaint filed by the Smt.Geetha K. Suvarna would reveal that she is the President of Janani Charitable Trust and also the office bearer of a political party. Accused No.1, who got acquainted to her, represented to her that he knew the Chief Minister and other political leaders of the party and assured her of securing a MLC seat to her and had demanded a sum of Rs.5 crore. Subsequently, he had stated to her because of his influence the amount was reduced and demanded payment of Rs.1.25 crores. At the - 4 - HC-KAR CNR: KAHC010599432026 NC: 2026:KHC:54382 CRL.P No. 13474 of 2026 instructions of accused No.1, the complainant allegedly handed over to accused Nos.2 and 3 a bag containing sum of Rs.1 crore at Shikskara Sabana Institute, where the petitioners are working as attenders. It is alleged that total amount of Rs.1 crore 50 lakhs was paid by the complainant to accused No.1, who allegedly had assured her of securing MLC seat. Except the allegation that at the instance of accused No.1, the complainant had handed over a bag containing sum of Rs.1 crore to accused Nos.2 and 3, who are working as attenders at Shikskara Sabana Institute, there is no other allegation as against the petitioners herein. The entire allegation of demanding money and cheating the complainant after the said money was paid is as against accused No.1 5. It is brought to the notice of this Court that further proceedings in Crime No.123 of 2026 registered by Halasur Gate, Police Station has been stayed as against accused No.1 by the Co-ordinate bench of this Court in - 5 - HC-KAR CNR: KAHC010599432026 NC: 2026:KHC:54382 CRL.P No. 13474 of 2026 Crl.P.No.12457 of 2026. The petitioners have undertaken to co-operate with the police for the purpose investigation. 6. Under these circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following : O R D E R (i) The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.123 of 2026 registered by Halasurgate Police Station, Bengaluru City for the offences punishable under Section 316(2), 318(4), 319(2), 351(2), 61(2), 74, 75, 79 of BNS 2023, subject to the following conditions: a) Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order - 6 - HC-KAR CNR: KAHC010599432026 NC: 2026:KHC:54382 CRL.P No. 13474 of 2026 and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witness and they shall co- operate with the police for investigation and appear before them whenever called upon. d) Petitioners shall not involve in similar offences in future.
