Meenaksh For Respondent ORDER Heard Mr.R.Raghu Raj, learned counsel for the petitioner and Mr.MMI.Khaleel, learned Government Advocate (Crl.Side) for the 1st Respondent and Mr.L.Meenakshi, learned counsel appearing for Mr.B.R.Jayaprakash Narayan, learned counsel for the 2nd respondent. 2. Learned counsel for the 2nd respondent submitted that this court referred the matter to the Mediation and conciliation Centre, High Court, Madras. Thereafter, the Mediator has submitted a report dated 06.05.2026 by which, it has been stated that the mediation is completed. There is a Settlement Agreement which has also been enclosed with the order of the Mediator. In the said Agreement, in paragraph No. 6 (A) to (D), the following conditions were laid down:- “A. Petitioner agreed to settle for a sum of Rs.11,00,000/- has a full and final settlement in C.C.No.9 of 2024 on the file of learned Special Court under TNPID (in F.Es) Act, Chennai. B. On 11.08.2022, the 2nd Respondent already received a sum of Rs.4,50,000/- from the petitioner. The petitioner has no objection to receive the Fixed Deposit dated 16.02.2026 for a https://www.mhc.tn.gov.in/judis CRL RC No. 228 of 2026 __________ Page4 of 8 sum of Rs.4,25,000/- (Rupees Four Lakhs Twenty Five Thousand only) which was deposited before the learned Special Judge Special Court under TNPID Act, Chennai in CC.No.9 of 2024 by the petitioner and the 2nd respondent can encash the same with accrued interest. C. The petitioner is agreed to pay the remaining amount for a sum of Rs.2,25,000/- to the 2nd respondent at the time of disposal of the Crl.RC.No.228 of 2026 which is pending before the Hon’ble High Court, Madras. D. By signing this Agreement the Parties hereto state that they have no further claims or demands in future in any manner whatsoever against each other with respect to C.C.No.9 of 2024 pending before the learned Special Judge, Special Court under TNPID Act, Chennai. All the Fixed Receipts, which were issued by National Sewing Thread Company Ltd., and NST Mills Private Limited in favour of Mr.A.Shanmugasamy and Smt.S.Dhanalakshmi for the total sum of Rs.23,50,000/- (Rupees Twenty Three Lakhs and Fifty Thousand only) are herewith settled as full and final settlement and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of conciliation/Mediation.” 3. Learned counsel for the petitioner submitted that as per the settlement agreement, her client has already received Rs.4,50,000/- on 11.08.2022 and today, a draft of Rs.2,25,000/- has been given by the petitioner in the name of the 2nd Respondent/A.Shanmugasamy to the learned counsel for the respondent before this court. https://www.mhc.tn.gov.in/judis CRL RC No. 228 of 2026 __________ Page5 of 8 4. Learned counsel for the Respondent has received the original draft and she has given a receipt on the photostat copy. She further submitted that the amount of Rs.4,25,000/- which is deposited before the learned Special Judge, Special Court under TNPID, Chennai in C.C.No.9 of 2024 may be directed to be withdrawn by the respondent deposited by the petitioner. 5. Accordingly, the respondent is directed to move an application before the learned Special Judge, Special Court under TNPID, Chennai in CC.No.9 of 2024 within a period of three weeks from today and if any such application is filed, the learned trial court is directed to release a sum of Rs.4,25,000/- in favour of the 2nd respondent/Mr.A.Shanmugasamy within a period of three weeks thereafter. 6. Thus, learned counsel for the respondent submitted that as per the settlement agreement, the entire amount of Rs.11,00,000/- has been paid and no amount is due and she has no objection to dispose of this case in terms of the settlement agreement and the petitioner may be discharged from the above case. 7. Accordingly, this Revision Case is disposed of in terms of settlement agreement dated 06.05.2026 and the parties are to abide by the terms and conditions as laid down by the settlement agreement in future also. https://www.mhc.tn.gov.in/judis CRL RC No. 228 of 2026 __________ Page6 of 8 . 8. Accordingly, this case is closed against the petitioner in CC.No.9 of 2024 and petitioner is discharged from the above case. This Criminal Revision Case is disposed of in terms of settlement agreement.
