103 29.09.2026 jb jdt. IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction WPA 2676 of 2026 Kamal Mahato vs. Election Commission of India & Ors. Afsana Khatun Ms. Manashi Das … For the Petitioner Ms. Anamika Pandey Ms. Madhushri Dutta … For the Election Commission of India Learned counsel for the petitioner having EPIC no. TJR 1254929 submits that the petitioner’s name has been deleted from the electoral roll through the Special Intensive Revision 2026 on the ground of alleged suspicion of linkage with the earlier electoral roll. The petitioner preferred an appeal against such deletion before the District Magistrate and District Election Officer, Jalpaiguri which is still pending. The petitioner seeks expeditious disposal of the same. In view of the fact that the appeal preferred by the petitioner is pending for a considerable period of time, the District Magistrate and District Election Officer, Jalpaiguri, being the 3rd respondent herein, is directed to consider and dispose of the same as expeditiously as possible, in accordance with law. 2 It is made clear that this Court has not gone into the merits of the claim of the petitioner made in the appeal and all issues are left open to be decided by the 3rd respondent in accordance with law. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J)
