135 29.09.2026 Ct. No.6 P.A./A,P IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction WPA No. 948 of 2025 Amirul Islam v/s The State of West Bengal & Ors. Ms. Ipsita Ghosh …for the petitioner. Mr. Kunaljit Bhattacharjee, Ld. AGP Ms. Radhika Agarwal …for the State. Pursuant to a work order issued in favour of the petitioner by the Block Development Officer, Kalchini on 16th October, 2023 for fencing over the existing wall at Punam Chand Mittal Memorial Ashram Hostel at Purba Satali under Kalchini Block, the petitioner completed the work successfully and raised bills for the same. The said bills were not cleared for which he submitted several representations as well as demand notice through his learned advocate before the concerned authority which were also not considered. The petitioner seeks consideration of the same. Placing reliance on the report in the form of affidavit submitted on behalf of the State, learned 2 counsel for the State submits that the work done by the petitioner does not conform to the estimate issued by the authority and therefore, no payment was made to him. The contention of the State does not find support in the estimate/scheme formulated for the purpose. Also, work order was issued sometime in 2023 whereas the inspection of the work was held in 2025. However, since the representations submitted by the petitioner are pending before the authority, the Block Development Officer, Kalchini Block, being the 7th respondent herein, is directed to consider and dispose of the same within 4 weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the authority arrives at a decision in favour of the petitioner, necessary consequential steps be taken at the earliest. The writ petition is disposed of accordingly. There shall however be no order as costs. 3 Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
