IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction
WPA No. 1245 of 2026
Chandan Kumar Dahal
Vs.
The State of W.B. & Ors.
Mr. Debajit Kundu…for the petitioner.
Mr. Bikramaditya Ghosh …for the private respondent. Mr. Shubhankar Dutta Ms. Manisha Dutta ..for the State.
Affidavit of service filed by the petitioner is taken on record. The petitioner challenges the genuineness of the birth certificate issued in favour of the private respondent primarily on the ground that it has been issued upon fraud and misrepresentation. The petitioner submitted a representation in this regard before the concerned authority on 4th December, 2025 which is yet to be considered. The petitioner seeks consideration of the same.
Learned counsel for the private respondent denies and disputes the allegation raised by the petitioner and submits that since a partition suit is pending between the family members including the petitioner and the private respondent, the present application is a ploy of the petitioner to deprive the
2 private respondent of his legitimate claim in the property of the family. In view of the rival contention of the parties involving factual disputes, the Pradhan, Lower Ichhey Gram Panchayat, being the 5th respondent herein, is directed to consider and dispose of the representation submitted by the petitioner dated 4th December, 2025 within four weeks from the date of communication of this
order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. The parties shall be at liberty to produce relevant documents in support of their respective contention before the authority at the time of hearing. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of accordingly. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
