The petitioner’s father owned property comprised in Old Grama Natham Survey No.145/1, as per the Patta No.205, New Survey No.362/12 to an extent of 210 square meter situated at Mahajanampakkam Village, Anakavoor Panchayat Union, Cheyyar Taluk, Thiruvannamalai District. Thereafter, the petitioner’s father settled the said property in favour of the petitioner by the registered Settlement Deed dated 20.03.2015 registered vide Document No.874 of 2015 on the file of Sub-Registrar Office, Thusi.
Thereafter, the revenue records were also mutated in the name of the petitioner. While being so, on 04.10.2024 the petitioner had conducted Boomi Pooja for putting up construction in the said property. At this juncture, the respondents 6 to 9 herein without having any right over the said property, stopped the Boomi Pooja and claiming that the said land is used for temple festival and objected to put up any construction in the said patta land. Therefore, the petitioner applied for survey of his property with requisite fee. However, the Surveyor could not able to survey the land since the respondents 6 to 9 were objected. Hence, the petitioner was constrained to approach this Court by way of filing writ petition in W.P.No.11159 of 2025 and this Court by an order dated 04.04.2025 directed the 3rd respondent to survey the land with the police aid. Thereafter, it was surveyed and demarcated boundaries of the petitioner’s property. Even then the 3/6 https://www.mhc.tn.gov.in/judis
W.P.(Crl).No.110 of 2026 respondents 6 to 9 objecting the petitioner from putting up any construction in the subject land. 3. The learned counsel appearing for the respondents 6 to 9 submitted that the subject land belonged to the Temple and the subject land is used for conducting festival of the temple. However, he would not able to name the temple at all and they erected one stone statue in the petitioner’s patta land and objected the petitioner to put up any construction in his patta land. 4. Heard the learned counsel appearing on either side and perused the materials available on record. 5. If at all there is any right over the subject property, the respondents 6 to 9 ought to have approached the Civil Court for appropriate relief. 6.
In view of the above, the 5th respondent is directed to provide adequate police protection to the petitioner and his labourers while removing the stone statue erected by the respondents 6 to 9 herein in the patta land owned by the petitioner, forthwith. With the above direction, the Writ Petition (Criminal) is allowed.
