Learned advocate for the petitioner submits that the instant revisional application has been filed challenging the order dated July 29, 2022 whereby an application under Order IX Rule 13 of the Code of Civil Procedure was received by the Learned Trial Court and notices were directed to be issued. 2. It is further submitted by the learned advocate for the petitioner that the proceedings of Misc. Case No. 129 of 2022 under Order IX Rule 13 of the Code of Civil Procedure at the behest of the judgment debtor/defendant, was stayed by this Hon’ble Court in a separate proceeding by an order dated 13th March, 2023. By such order the further proceeding of Misc. Case No. 129 of 2022 was directed to be stayed. 3. Learned advocate for the petitioner submits that in view of such order passed in the other proceeding, the petitioner does not wish to proceed with the instant revisional application. 4. In such circumstances the instant revisional application being C.O. 587 of 2023 is disposed of as infructuous. (Md. Shabbar Rashidi, J.)
