This bail application has been filed on behalf of Aslam Ansari who is in custody since 24.10.2025 in connection with Jamtara Cyber Crime P.S. Case No. 65 of 2025 for the offence registered under Sections 11(2)(b), 317(2), 317(4), 317(5), 318(4), 319(2), 336(3), 338, 340(2), 3(5) of the B.N.S., 2023 and under Section 42(3)(e) of Telecommunication Act, 2023 and under Section 66(B)(C)(D) of the Information Technology Act, pending in the Court of learned Special Judge Cyber Crime, Jamtara is pressed into motion. As per the FIR, on secret information that some persons being involved in cybercrime, raid was conducted in which altogether five persons including this petitioner were arrested from the spot. Huge cache of mobile sets and ATM Cards were seized from the accused persons. One iPhone and a Samsung Mobile set with sim cards were also seized from the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been apprehended in this case only on the basis of suspicion and the investigation has failed to link the petitioner to any cybercrime. Learned counsel for the State has opposed the prayer for bail and submitted that it has come in para 84 of the case diary that victim Rahim Khan was defrauded by IMEI link which was traced to named accused-Aslam Ansari. It is also contended that this petitioner has criminal antecedent in Jamtara P.S. Case No. 01/2024 for offence of similar nature. 2026:JHHC:2325 Considering the nature of offence and materials on record. I am not inclined to enlarge the petitioner on bail.
