Also heard Ms. R Devi, learned counsel appearing on behalf of Mr. A Chamuah, learned counsel for the opposite parties. The present Interlocutory Application has been filed to implead the opposite party no.2, namely, Sri Chinmoy Kumar Phookan as the party respondent no.2 in Contempt Case No.661/2019 as it is submitted that the opposite party no.2 is presently holding the post of the Managing Director, Assam State Transport Corporation. Learned counsel for the respondents does not object to the prayer made and submits that this Interlocutory Application may be allowed. Since the opposite party no.1 has demitted his office during the pendency of the contempt petition, therefore the opposite party no.2 is impleaded in the Page No.# 3/3 contempt petition as the respondent no.2. As it is submitted that the directions contained in the order dated 03.09.2018 passed in WP(C) No.5961/2018 has not been complied with, this Court is of the view that the prayer made in the Interlocutory Application should be allowed. Accordingly, let the opposite party no.2, Sri Chinmoy Kumar Phookan, who is presently the Managing Director of ASTC be arrayed as the respondent no.2 in the Contempt Petition, as he would be required to apprise the Court regarding the compliance of the directions of the Court’s order dated 03.09.2018 passed in WP(C) No.5961/2018.
