The relief sought in this Writ Petition is to direct the 1st Respondent to dispose of the Petitioner’s Statutory Appeal dated 29.10.2025 challenging the Resolution Item No.232/25 in R.C.No.1264/25/B4/KPM dated 16.07.2025 passed by the 2nd Respondent published in the Government Gazette dated 17.09.2025, within a time frame to be fixed by this Court. https://www.mhc.tn.gov.in/judis

The case of the Petitioner is that 2nd Respondent has passed a Resolution Item No.232/25 in R.C.No.1264/25/B4/KPM dated 16.07.2025 in the Tamil Nadu Government Gazette published on 17.09.2025, in and by which, the Tamil Nadu Wakf Board, ordered to take over the Olimuhammadpet Jumma Masjid Wakf, Big Kancheepuram under the direct management of Tamil Nadu Wakf Board from 16.07.2025 and appointed the Executive Officer, Chennai and Poonamallee Zone Direct Management Waqfs as the Executive Officer of Olimuhammadpet Jumma Masjid Wakf, Big Kancheepuram. bearing Na.Ka.No.77/Ne/A2/2025/Kanchi, directed the Petitioner to hand over all the records, title deeds, accounts and audit reports of the Olimuhammadpet Jumma Masjid Wakf, Big Kancheepuram to the Executive Officer, Chennai and Poonamallee Zone Direct Management Waqfs, on 13.10.2025 at 11.30 a.m. Challenging the Resolution Item No.232/25 in R.C.No.1264/25/B4/KPM dated 16.07.2025 passed by the 2nd Respondent, Petitioner preferred a Statutory Appeal under Section 65(2) of the Wakf Act, 1995 before the 1st Respondent. The Petitioner had filed the Statutory Appeal on 29.10.2025, however, till date, 1st Respondent has neither numbered the said Appeal nor taken up the same for

5. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited prayer sought by the Petitioner, this Court, without going into the merits of the case, directs the 1st Respondent to consider the Statutory Appeal dated 29.10.2025 filed by the Petitioner, if not considered earlier and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of personal hearing to the Petitioner as well as any other interested parties, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the Petitioner as well as any other interested parties.
