Saran Prasad For Respondent(s): Mr.M.Mohamed Riyaz, Government Advocate ORDER This Criminal Original Petition is filed to quash the proceedings in S.C.No.201 of 2026. 2. I have heard the learned counsel for the petitioner and the learned Government Advocate appearing one behalf of the respondent. 3. Upon going through the gravamen of the allegations in the final report, it is alleged that the first petitioner had extramarital relationship with the accused no.2, the daughter unable to bear the same, took the pressure on herself and committed suicide. The further allegations is that in the complaint the grand parents have stated in the case, the petitioners herein namely the mother and brother scolded the daughter, the incident had happened. 4. The contention of the learned counsel for the petitioner is that this is a case of extreme step taken by the daughter on account of her own depression and there is no any overt act attributable on the part of the mother or brother which would cause the triggering event soon before the death of the person. https://www.mhc.tn.gov.in/judis

5. I have already considered the case on behalf of the alleged paramour/accused no.2 and have entertained the quash application and granted stay in respect of that person on the ground that except for being alleged to be in relationship, no other allegations are there.
As far as these petitioners are concerned, when the offence is serious is nature whether their overt act in the nature of having extra marital relationship is true or not, whether their action of scolding the deceased can be considered as an act which is proximately connected to the suicide or not are all matters of trial and cannot be conclusively and incontrovertibly decided by this Court in the quash application and as such this petition which is filed on behalf of A1 and A3 is not entertained and dismissed. Consequently the connected miscellaneous petition is closed. 6. At this stage the learned counsel for the petitioners pleads for dispensing with the presence of the petitioners on the ground of hardship. It is stated that the first petitioner is the mother of the deceased and the second petitioner underwent heart surgery.
