28.09.2026 Court No.35. D/L. 33. Kausik (Rejected) CRM (M) 1917 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Beldanga Police Station Case No. 509 of 2022 dated 26.08.2022 under sections 302/34 of the Indian Penal Code read with sections 25/27 of the Arms Act. And In the matter of : Goljar Sk @ Waskurni @ Waskurni Sk @ Goaljar @ Washkuruni ……Petitioner. Ms. Arushi Rathore Mr. Arnab Kumar Neogi Mr. Sourav Samanta ……for the Petitioner. Mr. Pritam Roy Ms. Anindita Mukherjee ….for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 4 years and is unnecessarily languishing in jail. There is no possibility of the trial being concluded in near future. As such, petitioner may be granted bail. State has opposed the prayer for bail and submits that petitioner is not similarly situated as the other accused person. I have taken into account the materials appearing in the case diary and I find the prosecution case is that petitioner 2 jumped at the chest of the deceased and practically chopped the head of the victim/deceased. Having considered the heinousness of the offence, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 1917 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. Learned Trial Court would expedite the process of trial. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
