Crime No.1 of 2024. ..Respondent This petition filed under Section 528 of BNSS Act, 2023 to modify the condition that “accordingly the petitioner is ordered to be released on bail on condition to execute separate bond for a sum of Rs.10,000/-(rupees ten thousand only) each with two sureties each for a like sum to the satisfaction of the XI Metropolitan Magistrate, Saidapet” imposed in the order dated 19.09.2024 in Crl. It is the contention of the of the learned counsel for the petitioner that, inspite of enlargement of bail in the month of September 2024, the petitioner being a Malaysian citizen, he find it difficult to arrange for sureties. Hence, she prayed to enlarge him on his own bond. 2.It is also the contention of the learned counsel for the petitioner that in view of the G.O.(ID) No.141 (Public (Foreigners-III), Department) dated 18.09.2024, even if he is released, he will be kept in Special Camp at Trichy, during the period of bail. She would also relied upon the order passed by the learned Principal Sessions Judge in Crl.M.P.No.2591 of 2026 dated 17.03.2026 against the similarly placed person / A1. 3.In such view of the submissions and the fact that the petitioner has remained in incarceration despite having been granted bail on 19.09.2024, the Court is inclined to modify the bail condition. However, the Jail Authorities is directed to follow G.O. (Ms.) No. 141, Public (Foreigners-III) Department, dated 18.09.2024 and this petitioner may be kept in a Special Camp at Trichy, during his period of bail.
