In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Dhantala Police Station Case No.851 dated 12.10.2025 under Sections 329 (3)/79/74/115(2)/118(2)/109/3(5) of the BNS 2023. And In the matter of: Sushama Ray @ Sushoma Roy & others. …. Petitioners
Mrs. Subhasree Patel Ms. Shruti Mukhopadhyay
…for the petitioners
Ms. Zareen N. Khan Mr. Atif Ahmed Siddiqui
..for the State
Learned counsel appearing on behalf of the petitioners submits as follows. Out of a total number of eight accused, one was granted anticipatory bail and another was granted bail by the Sessions Court. Charge sheet has already been submitted. The petitioners have been falsely implicated in this case.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the injury reports, one of which shows multiple cut injuries on different parts of the body including on a vital portion like the chest. A cut injury was there measuring 5 inches X 2.5 inches. He also refers to the statement of the victim and the other witnesses, which implicate the petitioners.
Considering the above and the other materials available in the case diary and the fact that the petitioner no.1 and the petitioner no.4 are the female members of the household, while I am inclined to grant anticipatory bail to the petitioner nos. 1 and 4, the application for anticipatory bail of the petitioner nos. 2, 3 and 5 is rejected.
