ORDER:
This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer:
“…to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.4 and 5 in interfering with petitioners construction activity in the house sites in Sy.No.887/4 of Bommepalli Reddenna Colony, C.K.Dinne Village fields, C.K.Dinne Mandal, Y.S.R District stating that the same is belong to Government without adhering to due process of law as arbitrary, illegal, colourable exercise of power and voilative of fundamental and Constitutional rights guaranteed to petitioners under Articles, 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents No.4 and 5 not to interfere with petitioners construction activity in the house sites in Sy.No.887/4 of Bommepalli Reddenna Colony, C.K.Dinne Village fields, C.K.Dinne Mandal, Y.S.R District and pass…”
2. The petitioners herein claim to be the owners of various extents of house sites situated in Sy.No.887/4 of Bommepalli Reddenna colony, C.K. Dinne village fields, C.K. Dinne mandal, Y.S.R. Kadapa district and subsequently, they got approval from C.K. Dinne Gram panchayat for construction of houses in the said sites. 3. While the matter stood thus, the respondent Nos.4 and 5 started interfering with the petitioners’ possession over the subject house

sites alleging that the same belong to the Government. Aggrieved by the said action, the present writ petition is filed. 4. When the writ petition came up for admission on 09.03.2018, this Court has passed the following order:
“In the meanwhile, respondent Nos.4 and 5 shall not interfere with the construction activity of the petitioners, provided the petitioners make the construction in accordance with the sanctioned plan and in the land held by them under a valid title. If the construction is made in the Government land, respondent Nos.4 and 5 can issue appropriate notice and take action in accordance with law.”
5. Heard Sri. V.R. Reddy Kovvuri, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. 6. Perused the material available on record.
Today when the writ petition came up for hearing, learned Assistant Government Pleader furnished a copy of instructions of the 4th respondent dated 18.06.2026 enclosed with a copy of resumption proceedings of the 4th respondent dated 12.06.2018 which discloses that the subject lands have already been resumed by the Government as the said lands have entered into the list of Government lands already furnished to the Sub-Registrar, Kadapa during the year 2007 duly prohibiting registration. It is further stated that the said lands have been mutated as Assessed Waste in all the concerned revenue records. 8 VS,J W.P.No.7789 of 2018

In view of the fact that the lands claimed by the petitioners are all Government lands as can be seen from resumption proceedings dated 12.06.2018, this Court is of the opinion that the cause in the writ petition would not survive for further adjudication. However, the petitioners are at liberty to challenge the resumption proceedings dated 12.06.2018 of the 4th respondent, if so advised. 8. Accordingly, this writ petition is disposed of. There shall be no
order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this Petition shall stand closed. _____________________
