Mr. S.S. Yadav, learned counsel for the petitioners. 2. Mr. K.N. Joshi, learned Deputy Advocate General for the State of Uttarakhand. 3. Petitioners are serving as Collection Peon in District Champawat. By means of this writ petition, they have sought the following reliefs:- (i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 1, 2 and 3 to consider the case of the petitioners for providing the benefit of 2nd A.C.P. and also consider the case of the petitioners for promotion from the post of Collection Peon to the post of Collection Amin as per Government Order dated 04.06.2020 (Annexure No. 6 to the writ petition) and Government Order dated 12.07.2021 (Annexure No. 8 to the writ petition). (ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 1, 2 and 3 to rectify the fixation of 1st A.C.P. of the petitioners since 2008 instead of 2010 and further prayed to direct the respondents to sanction the benefit of 2nd A.C.P. since 2014 and pay the entire arrears of accrued amount in favour of the petitioners as early as possible. 4. Learned counsel for the petitioners submits that petitioners were given benefit of first ACP w.e.f. 2010 and not from 2008 when it became due. It is further contended that petitioners became eligible for second ACP in 2014, but such benefit was given to them w.e.f. 2016. It is contended that their claim for promotion is not being considered. 2026:UHC:3354 5. Learned State Counsel submits that petitioner no. 1 was promoted as Collection Amin on 30.06.2022. He submits that other petitioners will be considered for promotion as and when vacancies are available in promotion quota posts. He further submits that petitioners were regularised on the post of Collection Peon only w.e.f. 10.05.2007, however, the date of their regularisation was altered to 09.11.2000 vide order dated 03.01.2014; first ACP is payable upon completion of ten years satisfactory service on a post, therefore, petitioners were rightly given benefit of ACP w.e.f 09.11.2010. 6. Learned counsel for the petitioners submits that petitioners were in regular service since 1988, therefore, they are entitled to first ACP w.e.f. 2008. 7. Without going into the rival contentions made by learned counsel for the parties, this Court thinks that the ends of justice would be met, if petitioners are permitted to make separate representation(s) to the Competent Authority. 8. The writ petition is, accordingly, disposed of by permitting petitioners to make separate fresh representation(s) to District Magistrate, Champawat. If they make such representation(s) within two weeks from today, decision thereupon shall be taken, as per law, within ten weeks thereafter.
