Petitioner has filed this writ petition seeking following reliefs:- “10.1. That, this Hon’ble Court may kindly be pleased to strictly issue direction to the respondent to consider pending claim representation and to grant leave encashment,pension, gratuity, GPF and all other retiral dues with arrears and 18% interest with all consequential benefit within stipulated time with interest, in the interest of justice. 10.2.Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. Learned counsel for petitioner submits that petitioner while working on the post of Chief Municipal Officer stood retired from service upon attaining age of superannuation, on 30.6.2025. However, since the date of retirement, petitioner is not being paid retiral dues. Petitioner submitted representation before respondent No.2 on 5.1.2026 (Annexure P-1) which too is also not considered and no decision is taken till date. Therefore, a direction be issued to respondent No.2 to take decision on representation submitted by petitioner. 3 3. Learned State Counsel would submit that she is having no objection to the limited prayer made by learned counsel for petitioner. 4. Heard learned counsel for the parties and perused the documents annexed along with writ petition. 5. On due consideration of submission of learned counsel for the parties, this writ petition is disposed of with a direction to respondent No.2 to take decision on pending representation of petitioner dated 5.1.2026 (Annexure P-1) regarding release of retiral dues in accordance with law expeditiously, preferably within a period of two months from the date of receipt of the order. 6. Petitioner will also be at liberty to submit fresh comprehensive representation before respondent No.2 for redressal of his grievance as raised in this writ petition. If petitioner files such representation, respondent No.2 shall consider and decide the same, along with pending representation, in accordance with law expeditiously preferably within an outer limit of two months from the date of receipt of such representation.
