The case of the prosecution is that the petitioner had committed aggravated sexual assault upon the victim girl, aged 11 years. Hence, the case. 3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted the statement given by the victim recorded under section 183 of BNSS. He further submitted that the investigation is still pending. Hence, he opposed the grant of bail to the Petitioner. 5. I have given my anxious consideration to either side submissions and perused the materials available on record. 6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); and on perusal of the 183 statement recorded under BNSS, there is serious allegations https://www.mhc.tn.gov.in/judis CRL OP No. 16865 of 2026 __________ Page3 of 4 of penetrative sexual assault against the petitioner. Considering the serious allegation against the petitioner, this Court is of the firm view that it is not appropriate to enlarge the petitioner on bail. 7.
