The case of the prosecution is that the petitioner was found in possession of 22 kgs of ganja. Hence, the case. 3. The learned counsel appearing for the petitioner submitted that this is the third bail application filed by the petitioner. He further submitted that the petitioner was arrested and remanded to judicial custody since 06.07.2025. Placing reliance on the order of this Court in Crl.OP.No.5338 of 2026, he submitted that the recovery from the petitioner was only 11 kgs of ganja, which is an intermediate quantity. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that both the accused were arrested at the same place and the recoveries were effected simultaneously and totally 22 kgs of ganja was recovered, which falls within the commercial quantity. He further submitted that there is a nexus between both the recoveries and that there are materials to connect the conspiracy between both the accused. I have given my anxious consideration to either side submissions and perused the materials available on record. 6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side), this Court finds that, though the learned counsel for the petitioner relied upon the order of this Court in Crl.OP.No.5338 of 2026 dated 16.03.2026, the prosecution has placed materials to connect the petitioner with the recovery. Therefore, this Court is unable to record its satisfaction that the petitioner has made out a case to overcome the rigours under Section 37(1)(b)(ii) of the NDPS Act. Hence, this Court is not inclined to grant bail to the petitioner. 7.
