For Petitioner : Mr.P.Rajkumar Pandian For Respondent : Mr.R.Rajasekaran, Counsel for Government of Tamil Nadu (Crl.Side) https://www.mhc.tn.gov.in/judis CRL.O.P.No.16604 of 2026 __________ Page2 of 6 ORDER This Criminal Original Petition has been filed seeking modification of the condition imposed on the petitioner in paragraph 5(ii) of the order dated 08.05.2026 passed in Crl.M.P.No.206 of 2026 by the learned District Munsif-cum-Judicial Magistrate, Madhavaram, directing the petitioner to appear and sign before the concerned respondent Court daily at 10.30 AM for 30 days, without fail, from the date of release from prison. 2. The learned counsel for the petitioner submitted that though the petitioner was released from prison on 22.05.2026, he is unable to comply with the daily signing condition. He further submitted that by a subsequent order of this Court dated 18.06.2026 passed in Crl.M.P.No.10036 of 2026, the petitioner was also directed to appear and sign before the Saidapet Police Station and Puzhal Police station. The learned counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondent, submitted that the present petition is belated as the petitioner was released from prison as early as on 22.05.2026, but has taken steps to modify the condition only now. 4. Considering the rival submissions and the facts and circumstances of the case and noting that the case is still pending investigation by the Police, this Court is of the view that it would be appropriate if the petitioner reports before the investigating Police Station instead of the Court. 5. Accordingly, the condition imposed in paragraph 5(ii) of the order dated 08.05.2026 passed in Crl.M.P.No.206 of 2026 by the learned District Munsif-cum-Judicial Magistrate, Madhavaram, directing the petitioner to appear and sign before the concerned respondent Court daily at 10.30 AM for 30 days, without fail, from the date of release from prison, is modified to the extent that the petitioner shall appear and report before the Inspector of Police, Puzhal Police Station at 11:30 AM on every Tuesday and Friday for a period of three (3) consecutive weeks. Thereafter, no further reporting by the petitioner is required. All other conditions imposed in the order dated 08.05.2026, shall remain unaltered. 6.
