28.09.2026 Item no. 8 Ct. No.237 AKG
C.R.R. 793 of 2026 With CRAN 1/2026 Hasina Bibi Vs. Union of India
Mr. Tapas Kumar Ghosh, Mr. Tanmoy Chowdhury …for the Petitioner Mr. Arun Kumar Maiti (Mohanty), Mr. R. R. Mohanty …for NCB
The petitioner challenges an order dated January 7, 2026, passed by the learned Additional Sessions Judge-cum-Judge, Special Court, Hooghly, whereby the bail granted to the petitioner was cancelled. It appears that the petitioner was granted bail by this Court by order dated July 29, 2025, inter alia, subject to the condition that the petitioner shall not leave the geographical limits of the district of Hooghly without the leave of the learned trial Court and shall report to the Inspector-in-Charge, Pandua Police Station, District Hooghly, once a week at a time convenient to the police authorities, between sunrise and sunset, until further orders. It, however, appears that the learned Additional Sessions Judge cancelled the bail of the petitioner, admittedly, on the ground that the petitioner had admitted herself to a nursing home
2 situated outside the jurisdiction of the learned trial Court without obtaining leave of the Court. Learned advocate appearing for the petitioner submits that the petitioner did not deliberately violate any condition of the bail. It is submitted that she had admitted herself to a hospital beyond the jurisdiction of the learned trial Court solely for medical treatment. Due to a communication gap between the petitioner and her learned advocate, prior permission could not be obtained from the learned Court below. The learned advocate appearing for the petitioner, however, undertakes that, in future, the petitioner shall strictly comply with all the conditions imposed by this Court while granting her bail and shall not violate any such condition. Having regard to the aforesaid facts and circumstances, this Court is of the view that the order dated January 7, 2026, passed by the learned Additional Sessions Judge, is liable to be set aside and the same is accordingly set aside. It is directed that the petitioner shall surrender before the learned Additional Sessions Judge within a period of two weeks from the date of this order.
In the event the petitioner surrenders before the learned Additional Sessions Judge within the aforesaid period, the learned Judge shall allow the petitioner to remain on bail on the same terms and conditions as were imposed by this Court by order dated July 29, 2025. 3 It is made clear that, in the event the petitioner fails to surrender before the learned Additional Sessions Judge in terms of this order, the learned Sessions Judge shall be at liberty to proceed in accordance with law, including by giving effect to the warrant of arrest issued against the petitioner. Accordingly, CRR 793 of 2026 along with CRAN 1/2026 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Kausik Chanda, J.)
