Accused nos.1 to 3 in Crime No.182 of 2026 registered by Koratagere Police Station, Tumakuru District for offences punishable under Section 310(4) and 310(5) of BNSS, 2023 are before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent - State. 3. FIR in Crime No.182 of 2026 was registered by Koratagere Police Station, Tumakuru District against five to six unknown persons, based on first information dated 15.08.2026, received from Sri Teerthesha Y G, police officer attached to Koratagere Police Station. In the said case, petitioners were - 3 - HC-KAR CNR: KAHC010650552026 NC: 2026:KHC:54475 CRL.P No. 14792 of 2026 arrested on 16.08.2026 and remanded to judicial custody. Their bail applications filed before the jurisdictional Sessions Court in Crl.Misc.No.5318 of 2026 and Crl.Misc.No.5341 of 2026 were rejected on 03.09.2026 and 07.09.2026 respectively. Therefore, they are before this Court. 4. A reading of the first information would reveal that on 15.08.2026 at about 10.15 p.m. when the first informant was in the police station he had received credible information to the effect that about five to six unknown persons armed with weapons were preparing themselves for committing dacoity. On receipt of such information, the first informant along with the staff had gone to the place where accused persons were preparing themselves for committing dacoity. In the first information, it is stated that thereafter, an information was forwarded to the police station through P.C.No.667 - Kantharaju and FIR was registered in the present case. The petitioners herein were subsequently arrested on 16.08.2026 during the course of investigation. - 4 - HC-KAR CNR: KAHC010650552026 NC: 2026:KHC:54475 CRL.P No. 14792 of 2026 5. As against, accused no.3, there is no criminal antecedents. Accused nos.1 and 2 are said to have involved in one another criminal case registered for offence punishable under Section 307 of IPC. It is not in dispute that in the said case, accused nos.1 and 2 have been enlarged on bail. Insofar as the present case is concerned, major portion of investigation is completed. 6. Considering the aforesaid aspects of the matter and nature of allegations found in the first information, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioners are directed to be enlarged on bail in Crime No.182 of 2026 registered by Koratagere Police Station, Tumakuru District for offences punishable under Section 310(4) and 310(5) of BNSS, 2023, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010650552026 NC: 2026:KHC:54475 CRL.P No. 14792 of 2026 a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future: e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
