This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of pre-arrest bail to the petitioner, namely, Shri Rana Protap Pegu, in connection with Silapathar Police Station Case No.42/2026 under Sections 351(2)/79 of the Bharatiya Nyaya Sanhita, 2023 read with Section 67(A) of the Information Technology Act, 2000. The informant of the present case had lodged an FIR on 09.03.2026 before the Officer-in-Charge of Silapathar Police Station alleging that the Page No.# 2/2 petitioner had posted abusive and sexually explicit comments directed at her and her parents on Instagram. It appears that there was a love relationship between the informant and the brother of the present petitioner which ultimately got terminated. This Court by order dated 25.03.2026 had granted interim protection to the petitioner, pursuant to which he has appeared before the Investigating Officer and his statement has been recorded. Having regard to the nature of the allegations, custodial interrogation of the petitioner does not appear to be necessary. Having regard to the same, the prayer for pre-arrest bail is allowed.
