JUSTICE JAYANT BANERJI) The contempt petition is filed alleging willful disobedience of the order dated 22.01.2025 passed in Writ Petition No.23231/2024 whereby this Court directed the respondent Nos.2 to 4 therein to forthwith conduct phodi and durasti by taking cognizance of the title deeds obtained by the petitioner. - 3 - HC-KAR CNR: KAHC010145772026 NC: 2026:KHC:55621-DB CCC No. 256 of 2026 2. An affidavit of G.S. Shreyas, the Tahsildar of K.R.Pete Taluk, Mandya District in paragraph No.5 of which it is stated that in response to a notice issued by the Tahsildar on 12.03.2025, the complainant produced xerox copies of Form No.10 and manual order copy of order dated 13.09.1979 issued by the Special Tahsildar, Land Reforms. 3. Upon verification of the said document in the record room of the office of the Tahsildar, it was found that the said Form No.10 was never issued with respect to the said Survey No.259/p23 and the said order in LRF No.45/74-75 also did not reflect the name of the alleged grantee Sri. Anjanappa son of Narayanappa. In view of the non availability of the record in favour of the alleged grantee and the doubtful nature of the documents, invoking the provisions of Sections 28 and 33 of the Karnataka Land Revenue Act, 1964, an enquiry was held where the complainant failed to produce the relevant documents or certified documents with respect to the grant. An order dated 06.05.2025 was passed by the Tahsildar rejecting their application for phodi and durasti. This contempt petition is therefore consigned, leaving it open to the complainant, if he is so advised, to challenge the order passed by the Tahsildar.
